Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Clearlake Carwash (“Clearlake Carwash,” “we,” “us,” or “our”) covering your access to and use of the Clearlake Carwash website, mobile experiences, RFID sticker, and car wash services (collectively, the “Service”). By creating an account, subscribing, or using any part of the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to create an account and subscribe. By using the Service you represent that you meet this requirement and that the information you provide is accurate and complete.

2. The Service

Clearlake Carwash sells monthly car wash subscriptions. Paid subscribers receive an RFID sticker that is affixed to a single designated vehicle’s windshield and grants unlimited drive-through car washes at participating Clearlake Carwash locations for the duration of the paid billing period, subject to normal business hours and these Terms.

Service features, pricing, wash technology, hours, and participating locations may change. We will make reasonable efforts to notify subscribers of material changes in advance.

3. Account Registration and Security

To subscribe you must create an account with a valid email address, a working phone number, and a password. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at contact@clearlakecarwash.com if you suspect unauthorized access.

4. Subscription, Billing, and Auto-Renewal

Subscriptions are billed monthly in advance through our payment processor, Stripe. By subscribing you authorize Clearlake Carwash and Stripe to charge your payment method on a recurring basis until you cancel. Subscriptions automatically renew at the end of each billing period at the then-current price unless canceled before the renewal date.

We may change subscription prices. We will give you at least 30 days notice by email before a price change takes effect. If you do not agree to a price change, you may cancel before the new price becomes effective.

You are responsible for all taxes, transaction fees, and bank charges associated with your subscription unless we state otherwise.

5. Cancellation

You may cancel your subscription at any time from your account at /account or through the Stripe customer portal linked there. Cancellations take effect at the end of the current paid billing period: you keep access through the end of that period, and you will not be billed for the following period.

6. RFID Sticker Terms

  • The RFID sticker remains the property of Clearlake Carwash and is licensed to you for the duration of your active subscription.
  • Each RFID sticker is linked to exactly one vehicle. Transferring, copying, cloning, or using a sticker on any vehicle other than the one it was issued for is a violation of these Terms and may result in immediate termination without refund.
  • You are responsible for affixing the sticker to the designated vehicle’s windshield in the location and orientation we specify.
  • Removing, tampering with, damaging, or obscuring the sticker voids your subscription and may result in denial of service.
  • On cancellation, the sticker is automatically deactivated. You should remove it from your vehicle.
  • Replacement stickers for lost, stolen, or damaged stickers may be subject to a replacement fee.

7. Acceptable Use

You agree that you will not:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
  • Attempt to defraud, deceive, or otherwise obtain wash services you have not paid for;
  • Reverse engineer, tamper with, clone, spoof, or interfere with any Clearlake Carwash hardware, RFID system, wash equipment, or software;
  • Share your sticker, account credentials, or subscription benefits with any vehicle or person not authorized under your subscription;
  • Damage, abuse, or interfere with the wash equipment, the property, or other customers;
  • Attempt to bypass security, rate limits, or access controls in our website or APIs;
  • Impersonate any person or misrepresent your affiliation with any person or entity.

We may suspend or terminate your account at any time without refund for any violation of this section.

8. Vehicle Condition and Safety

It is your responsibility to follow all posted safety instructions, attendant directions, and signage at our wash locations. Vehicles using the Service must be in generally good mechanical condition, with intact windshields, closed windows, secure mirrors and accessories, and no aftermarket parts that are unsafe for automated wash equipment. Clearlake Carwash is not responsible for damage to vehicles that are not in normal operating condition or that do not follow posted instructions.

9. Intellectual Property

The Service, including the Clearlake Carwash name, logo, website, mobile experiences, software, text, graphics, and RFID technology, is owned by Clearlake Carwash or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. We reserve all other rights.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEARLAKE CARWASH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN ALL CASES, CLEARLAKE CARWASH’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO CLEARLAKE CARWASH FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS.

12. Indemnification

You agree to defend, indemnify, and hold harmless Clearlake Carwash and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third party’s rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including if we reasonably believe you have violated these Terms. On termination your right to use the Service ends immediately. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will survive.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Lake County, California, and you consent to the personal jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date above and, for material changes, notify you by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Miscellaneous

These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and Clearlake Carwash regarding the Service. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our written consent; we may assign them freely.
